    • Anti Corruption Agency calls for changes in the draft Law on Data Confidentiality

    •
    • Date: 02 September 2009

In the letter sent to the Ministry of Justice, Civic Initiatives and the Centre for Civil-Military Relations (CCMR) Serbia's Anti Corruption Agency called for changes in the draft Law on Data Confidentiality.

Representatives of the Agency are calling the responsible institutions to change the disputed article 38 contained in the proposal. In the letter sent to CCMR, it is claimed how this article violates the principle of the division of powers, therefore "making the investigation and prosecution of the crimes related to corruption extremely difficult".

A paradoxical situation in its own right, it is also said, consists of the fact that all of the independent (state established) oversight bodies - including the Ombudsman and Commissioner for Access to Data of Public Importance - do not have the authority to examine those data deemed as "confidential" by the authority in the matter.
