{"id":35614,"date":"2025-01-26T10:25:05","date_gmt":"2025-01-26T09:25:05","guid":{"rendered":"https:\/\/bezbednost.org\/?post_type=publikacija&#038;p=35614"},"modified":"2026-02-10T13:06:17","modified_gmt":"2026-02-10T12:06:17","slug":"spyware-the-negation-of-human-rights-under-the-pretext-of-security","status":"publish","type":"publikacija","link":"https:\/\/bezbednost.org\/en\/publication\/spyware-the-negation-of-human-rights-under-the-pretext-of-security\/","title":{"rendered":"Spyware \u2013 the negation of human rights under the pretext of \u201csecurity\u201d"},"content":{"rendered":"<p>The Constitution, Criminal Procedure Code, Criminal Code and respective laws on intelligence services, electronic communication, personal data protection and information security have already set forth rigorous conditions for conducting secret monitoring, which spyware cannot meet in reality.<\/p>\n<p>International standards and comparative practice have confirmed significant differences: massive \u201ccollateral\u201d collection of third-person data, privacy undermining, compromising professional secrecy and protection of journalists\u2019 sources, abuse of the pretext of \u201cnational security\u201d and prevention of effective legal protection due to the secrecy of measures.<\/p>\n<p>In Serbia, there are already documented cases of targeting journalists and activists, without any accountability of the persons responsible for that.
